Problem: Are any documents (e.g. SPD, Safe Harbor notice) available in Spanish ? |
Solution: No. All of our documents are English only. Due to the complexities and potential for misinterpretation with no way for us to verify the accuracy, we do not offer the participant notices or SPDs in Spanish (or other languages). The Cycle 3 SPDs do have an option in AA §C-6 of the checklist to include a Spanish “assistance notice“ (or to write another foreign language equivalent) which will then feed into the title page of the SPD. While it is not the full SPD, at least the assistance notice will help those non-English speaking participants know who they can turn to for assistance with reading or understanding the content of the SPD. If AA §C-6(a) is completed, the following assistance notice, translated to Spanish, will be inserted on the cover page of the SPD: “This booklet contains a summary in English of your plan rights and benefits under [Name of Plan]. If you have difficulty understanding any part of this booklet, contact [Name of Plan Administrator], the plan administrator, at the office at [address, city, state, zip]. Office hours are from ________ A.M. to _______ P.M. Monday through Friday. You may also call the plan administrator's office at [insert phone number] for assistance.” There are online translation services that might be able to assist you.
